This website, i.e. MBRIDAL.COM (the "Site", the "Website", "MBridal") is operated by Monica's Bridal Inc. (collectively, "we", "us", "our" or "MBridal"). Your use of, and access to, this Site is subject to these Terms of Service (these "Terms", “TOS”, “TOU”, “Terms of use”). These Terms are a legal agreement between you and us, and they contain important information on your legal rights, remedies and obligations. By accessing, browsing or otherwise using the Site, you (I) acknowledge that you have read and understand, and are agreeing to be bound by these Terms and that you are agreeing to comply with all applicable laws, rules, policies and regulations; and (ii) represent that you are an adult of legal age and have the legal capacity to enter a contract in the jurisdiction where you reside.

This Site is not for anyone under 18 years (21 years in some jurisdictions) of age and in no event shall anyone under the age of 18 years (21 years in some jurisdictions) use the Site. You further acknowledge and agree that your access to and use of the Site and the services provided through the Site are valuable benefits that you receive by agreeing to, and complying with, these Terms. We respect your privacy and share your concern about its protection. Our Privacy Policy (https://mbridal.com/privacy) constitutes a part of these Terms and explains how we may collect, use and protect information that we learn about you as a result of your interaction with us through the Site. We may use this information to generate statistical reports to help us understand the market for our products and services and to develop promotional and marketing campaigns. We may use the contact information you provide to us to make you aware of other products and services.

OWNERSHIP

Monica's Bridal Inc., its subsidiaries, affiliated companies, distributors, vendors, contractors, and/or licensors (collectively, "Monica's Bridal", "MBridal") are the owners or licensees of all content and materials on the Site ("Site Content") and of all related intellectual property rights, including, without limitation, all copyrights, moral rights, trademark rights and patent rights. Site Content includes, without limitation all features, functions, services, software, algorithms, designs, objects, documentation, know-how, code, data, art, graphics, animation, photographs, images, text, music, sound effects, audio and/or audio-visual elements and downloadable materials on the Site, as well as the, look-and-feel, design, layout, organization, presentation, user interface, navigation and stylistic conventions of the Site. Site Content does not include Your Content, as that term is defined below.

You do not acquire any ownership interests in any Site Content by accessing, browsing or otherwise using or submitting content to the Site.

YOUR USE AND YOUR CONTENT; LICENSE GRANT; RIGHT TO MONITOR AND EDITORIAL CONTROL

You may access, browse and use the Site and Site Content only for your personal, non-commercial use, on a single computer, mobile phone or other Internet-compatible device to enable you to use the Site. You may not copy, reproduce, modify, distribute, transmit, display, perform, publish or otherwise use or exploit, through any means or media, any of the Site Content.

Certain features of the Site may allow you to post, upload, transmit or submit certain materials, content, information or ideas to the Site ("Your Content"). Except for Your User Information required to be provided in connection with Your Registration (as defined and described below), We do not ask for, nor do we wish to receive, any confidential, secret or proprietary information or other material from you through the Site, by e-mail or in any other way. By providing Your Content to us, you: (I) represent and warrant that Your Content is original to you, that you own or otherwise control all of the rights in Your Content, or that you have the rights necessary to grant to us the license to Your Content granted below, and that Your Content does not violate any rights, including the rights of privacy, of any party and does not otherwise violate the law; (ii) grant to us and our affiliates a world-wide, non-exclusive, fully paid-up, royalty-free, unrestricted, perpetual, irrevocable, fully transferable, assignable and fully sub-licensable (through multiple tiers) right and license, to copy, reproduce, edit, modify, distribute, transmit, translate, display, perform, publish, sell, adapt, create derivative works from, and otherwise use Your Content, for any purpose that we may choose, in our sole discretion, and through any means or media, whether now existing or subsequently developed, and without any compensation to you or any third party (it being understood that the foregoing shall include the right to exploit any and all intellectual property or proprietary rights in Your Content including, without limitation, rights protected under applicable copyright, trademark, trade secret, patent and other laws throughout the world); and (iii) indemnify and hold harmless us and MBRIDAL (i.e. Monica's Bridal Inc.) from and against any and all claims, actions and damages (including, without limitation, court costs, legal fees, accounting fees and amounts paid in settlement) that are related to or result from your use of the Site, Your Content or its posting on, or submission to, the Site, and/or your violation of these Terms or your representations and warranties hereunder. You will cooperate as fully as reasonably required in the defense of any such claim or action; however, we reserve the right, at our own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.

We cannot be responsible for maintaining Your Content, and we may remove Your Content from the Site at any time, for any and no reason, and without notice to you. We reserve the right, but do not have an obligation, to monitor and/or review all materials posted to the Site, or through the Site’s services or features, by its users, and we are not responsible for any such materials. However, we further reserve the right at all times to disclose any information as necessary to satisfy any law, regulation or government request, or to edit, refuse to post or to remove any information or materials, in whole or in part, that in our sole discretion are objectionable or in violation of these Terms or applicable law. We may also impose limits on certain features or restrict your access to part or all of the features or services without notice or penalty if we believe that you are in breach of these Terms or applicable law, or for any other reason, all without notice or liability.

PROHIBITED CONDUCT

You warrant and agree that, while accessing or using the Site, you will not:

impersonate any person or entity or misrepresent your affiliation with any other person or entity, whether actual or fictitious, including anyone from the Site, MBRIDAL or otherwise affiliated with us;
use the Site to advocate the use of controlled substances or the use of products or services offered or promoted on the Site in connection with controlled substances;
use an inappropriate username or screen name;
insert your own or a third party’s advertising, branding or other promotional content into any Site Content;
obtain or attempt to gain unauthorized access to other computer systems, materials, information or any services available on or through the Site through any means, including through means not intentionally made publicly available or provided through the Site;

use the Site or its services in violation of our intellectual property or other proprietary or legal rights or rights any third party;
use the Site or its services in violation of any applicable law;
attempt (or encourage or support anyone else’s attempt) to circumvent, reverse-engineer, decrypt, or otherwise alter, or interfere with, the Site or its services;
post, transmit, publish or otherwise disseminate through the Site any of Your Content that, as we determine in our sole discretion: (I) is unlawful, harmful, harassing, fraudulent, threatening, abusive, libelous, defamatory, vulgar, obscene, hateful, or racially, ethnically or otherwise objectionable, or infringes our or any third party’s intellectual property or other rights; (ii) is derogatory or harmful to the reputation of any of MBRIDAL or any of her or their respective officers, members, employees, representatives, licensors and/or suppliers, in any way; (iii) may incite violence or other unlawful activity; or (iv) is harmful to children in any manner.

YOU’RE REGISTRATION AND YOUR USER INFORMATION

Some of the services on the Site are only available if you register to create an account. When any of the services on the Site require you to register with us ("Your Registration") or otherwise provide user information ("Your User Information"), you must complete the registration process by providing us with complete and accurate information. You grant to us and to all other persons and entities involved in the operation of the Site the right to use, store, monitor, retrieve and transmit Your User Information in connection with the operation of the Site. Our information collection and use policies with respect to the privacy of Your User Information are set forth in our Privacy Policy, which is incorporated in these Terms by reference for all purposes.

You are solely responsible for maintaining the confidentiality of Your User Information. You are also solely responsible for any and all activities that occur under Your Registration or Your User Information. You must notify us immediately of any suspected or actual unauthorized use of Your Registration or Your User Information, and of any and all other security breaches.

We reserve the right to terminate Your Registration or to refuse services to you, without prior notice to you, at any time and for any or no reason. Without limiting the above, if you are a repeat copyright infringer, we will, in appropriate circumstances, permanently terminate Your Registration and remove your User Content from the Site. You have the right to cancel Your Registration at any time. You may cancel Your Registration by following the instructions on the Site.

If you voluntarily terminate Your Registration or allow Your Registration to lapse, you may reactivate Your Registration at any time through the account interface on the Site. Accounts terminated by us for any type of abuse, including without limitation a violation of these Terms, may not be reactivated.

If you elect to register, you agree to provide MBridal with accurate, complete registration information. You will inform MBridal of any changes to registration information. You warrant that registration is for a single person only, and that you will not permit anyone other than yourself to access and use sections of this Website requiring registration using your name and password. You are responsible for all access to and use of this Website through your name and password, including access of any services the use of which results in monetary charges to you, whether or not you have knowledge of or authorizes such access and use. You will notify MBridal immediately of any unauthorized use of your name and password, or if you suspect the privacy of your name and password has been jeopardized.

FEES THAT YOU MAY PAY

Some aspects of the Site may require you to pay a fee or other charge, the details of which are available in various areas of the Site that feature the ability to purchase products, features or services. You agree to pay all fees, charges and applicable taxes incurred by you or anyone using Your Registration. We may revise the pricing for products, services or features offered through the Site at any time. Unless otherwise noted, all currency references are in U.S. dollars. All fees and charges are payable in accordance with payment terms in effect at the time the fee or the charge becomes payable. If there is a dispute regarding payment of fees to, or products or services provided by, us, Your Registration may be closed without warning or notice at our sole discretion.

EXCEPT AS OTHERWISE SET FORTH IN ANY RETURN POLICY OR CANCELLATION POLICY APPLICABLE TO OUR FEE-BASED PRODUCTS, SERVICES OR FEATURES, YOU ACKNOWLEDGE AND AGREE THAT ANY APPLICABLE FEES AND OTHER CHARGES FOR FEE-BASED PRODUCTS, SERVICES OR FEATURES ARE NOT REFUNDABLE IN WHOLE OR IN PART. YOU ARE FULLY LIABLE FOR ALL CHARGES TO YOUR REGISTRATION, INCLUDING ANY UNAUTHORIZED CHARGES.

We may, from time to time, modify, amend, or supplement our fees and fee-billing methods, and such changes shall be effective immediately upon posting in these Terms or elsewhere on the Site.

MAP POLICIES

In many instances, we have agreed to sell certain products offered for sale on the Site subject to what is referred to as a "minimum advertised price," or "MAP" policy or “MSRP” or “MSRP” Policy. MAP is the lowest price distributors and other resellers are allowed to publicly display a product for sale. This practice is used by some manufactures to protect the integrity of their product(s) and brand. Generally, authorized retailers of a MAP protected product agree to adhere to these guidelines, failing which they risk losing the right to sell the product subject to that MAP policy. In addition, buyers may not be able to take advantage of post-sale services (i.e., warranty repair) when purchasing from a retailer that does not comply with a manufacturer’s MAP policy. MAP policies are intended to protect consumers and sellers from disreputable dealers, giving all authorized retailers specific guidelines on how to advertise the price of the MAP product(s). This helps to ensure that buyers will be able to access the high level of service the manufacture wants purchasers of their product(s) to receive.

SALES TAX

Sales tax applies to all online orders placed in New York State. The New York City sales tax is currently 8.875%.

SUBMISSION OF YOUR IDEAS AND SUGGESTIONS

While you are encouraged to share ideas and suggestions through your use of the Site, we wish to avoid any potential misunderstandings or disputes that may arise from the limited use that we or other users of the Site may make of any ideas or suggestions that you choose to share or if our content or business activities seem similar to any such ideas or suggestions. When you share ideas or suggestions through your use of the Site (collectively "Submissions"), you hereby grant us and our designees a worldwide, non-exclusive, fully paid-up, unrestricted, fully sub-licensable, fully transferable, assignable, royalty-free, perpetual, irrevocable right to copy, use, reproduce, edit, distribute, modify, adapt, create derivative works of, publish, publicly perform, publicly display, transmit, translate and license, digitally perform, make, have made, sell, offer for sale and import your Submissions in any and all embodiments, media and means of communication, now known or hereafter developed. You represent and warrant to us that your Submissions are original to you, that you own or otherwise control all of the rights in your Submissions, or that you have the rights necessary to grant to us the license to your Submissions granted above, and that your Submissions do not violate any rights, including the rights of privacy, of any party and do not otherwise violate the law. We agree that, if any Submission generates a sufficient level of popularity or mass appeal, as we may determine in our sole discretion, then we may enter into good faith negotiations with you of a royalty-bearing license agreement for exploitation of your Submission beyond the Site. Notwithstanding the foregoing, nothing in these Terms shall impose any obligation or requirement on us to proceed with or conclude any agreement or transaction with you concerning any such Submission. IF YOU DO NOT WISH TO GRANT THE RIGHTS GRANTED IN THIS PARAGRAPH, DO NOT SHARE, SUBMIT OR POST ANY SUBMISSION ON OR THROUGH THE SITE.

The Site contains links to websites of third parties, including, without limitation, advertisements of third party products and services and "buy" links to third party vendors or retailers to purchase products or services featured on the Site. If you use these links, you will leave the Site. These third parties and their websites are not under our control. We do not examine or evaluate these websites and we are not responsible for their content or operation. By providing links to these websites, we do not approve, warrant or endorse, or otherwise make any representation about, them or their owners or operators, and do not assume any related responsibility or liability. You should exercise your own judgment in evaluating and using these websites. When you link to these websites, you become subject to their terms and conditions of use and privacy policies.

LINKING TO THE SITE

You agree that if you implement a link to the Site (whether from another website or otherwise), such link shall open in a new browser window and shall link to the full version of an HTML-formatted page of the Site. You may not link directly to any Site Content by, for example and without limitation, "in-line" linking or "deep-linking" methods, or in any manner causing the Site, or any page of the Site, to be "framed," surrounded or obfuscated by any third-party content, materials or branding. We may, at any time and for any or no reason, require that any link to the Site be discontinued and removed and revoke your right to link to the Site.

ORDERING

It is highly recommend placing all orders as far in advance of your wedding and/or event as possible. You and/or your bridal party will need to permit sufficient time for the production, shipping, and/or any alterations that may be necessary.

MBRIDAL and/or our vendors reserve the right to change their delivery time frames at any point in time without any advanced notice.

MBRIDAL takes no responsibility for orders not delivered on time and/or in time for your event when orders are places with insufficient time to deliver item(s). As such these orders will be governed by and adhere to our return policy.

NO ALTERATIONS will be offered on dresses purchased through the MBRIDAL Site. Please contact your local tailor or seamstress to complete your alterations. If you reside in the greater New York area you may also opt to schedule an appointment for alterations to be done at our Monica's Bridal flagship store at your own expense. Purchases online do not and will not ever include alterations in the price of goods sold.

Currency is calculated in U.S. dollars (USD) only for all purchases.

SELECTING A SIZE

Our vendors create and provide their own sizing charts, which reflects the specific measurements they use to cut and determine their sizes. These size charts are located via link directly above the available sizes on each and every product on the site. It is imperative to follow the vendor’s size chart for the product to choose the size to order. Please note measurements are taken to determine the closest size to be ordered and the garment will not be custom-made to exact measurements. Almost all apparel will need some form and/or type of alteration.

Measurements and sizes are based on U.S. calculations

The vendor is unable to accommodate any changes to the size once the order has been placed. MBRIDAL is not and will not be responsible for the accuracy of your measurements and will grant no refund or credit for any products that did not fit due to inaccuracy in measurements and/or because of loss or gain of weight during the production and shipping process. Accurate measurements are fully the responsibility of the customer

The customer is responsible for the size ordered and whether or not to order extra or custom length. MBRIDAL cannot assume any responsibility for the size selected by the customer. In addition, our Customer Service representatives are unable to assist with measurements and cannot suggest a size.

MBRIDAL offers a size selection tool to help customers determine the size they need. By no means should this tool be considered perfect and/or without flaws. This tool was designed to give customers a helping hand, and customers should still do their own research and due diligence in regards to selecting the right size for them. MBRIDAL makes no guarantee that this tool is able to calculate sizes correctly and any mistakes in or when orders are made due to this tool is the customers responsibility. Use this tool completely at your own risk and MBRIDAL cannot and will not assume any responsibility for the size selected by the customers using this tool.

DRESS COLORS

Colors that are displayed on any website may vary from the actual fabric colors. We highly recommend contacting a local authorized retailer to physically view a fabric swatch of the manufacturer you are interested in ordering. Dress colors cannot be compared across different manufacturers. Please indicate the color you wish to order exactly as it is posted on our site. Many dresses are available in two-tone combinations and with trims. The customer is responsible for the color ordered. Once an order is placed, manufacturers will not make any changes or modifications to your order.

DYE LOT VARIATIONS

Vendors cannot standardize dye lots, so colors may vary from physical and online swatches. Colors can also vary between bolts of fabric even when ordering the same dress in the same color at the same time. Most variations are slight and a shade off. However, we strongly suggest placing a bridesmaid order at one time using our Bridal Party Registry with all of the dresses on the same order to try to avoid dye lot variation. Any bridesmaid orders placed separately or added-on to an order may be cut from a different bolt of fabric and vary in color. Additionally, dresses from the same vendor but different styles or dresses from different vendors will vary in dye lot. Fabric orders are always cut from a different bolt of material than dress orders. Please be aware that dye lot variation between the fabric and dress order may occur and that we cannot guarantee a color match. MBRIDAL makes no guarantee of exact color matches and you acknowledge that color accuracy may vary from dress to dress due to but not limited to things like oxidation, fabric bolt, production time, dye lots or other, even when ordering the same dress in the same color at the same time.

RETURN POLICY

The following comprises the entirety of MBRIDAL return policy as it applies to all merchandise sold at MBRIDAL:

Section I: Malfunctioning & Damaged items (excluding bridal/wedding gowns)

MBRIDAL shall provide any and all customers either exchange or store credit for any items which has arrived to the customer in either a damaged or malfunctioning condition. The Customer must report any and all malfunctions or damage within 48 hours (2) calendar days of delivery or no store credit, nor shall replacement be available to customer. In the case an item is returned that is found to be not defective, malfunctioning or damaged, MBRIDAL shall return the item(s) to the customer/sender at customers/senders expense. Credit issued for items will be valid for 1 year from date return (RMA) is issued

Section II: Standard Return Policy

MBRIDAL shall provide any and all customers either exchange or store credit for any items purchased excluding bridal/wedding gowns and special-order products. The Customer must submit an RMA request within 48 hours (2) calendar days of delivery or no store credit, nor shall replacement be available to customer. In the case an item is returned without an RMA approval, MBRIDAL shall return the item(s) to the customer/sender at customers/senders expense. Credit issued for items will be valid for 1 year from date return (RMA) is issued

**Note: No credit or exchange or otherwise any form of reimbursement shall be given or offered for any extra options such as but not limited to rush-cut, extra length, preservation kits and the such. Customer understands that the purchases of such extra options was at the customers own risk and will under no circumstances be the responsibility of MBRIDAL to credit, refund or reimburse in any way.

Section III: Return Procedure

No returns will be accepted without an RMA number which can be obtained through contact with customer care, RMA Department (https://mbridal.com/contact-us-and-store-hours). Any and all returns which arrive without an RMA number shall be rejected, and sent back to customer/sender; additionally, MBRIDAL will assess a shipping and handling fee at customers/senders expense.

Section IV: Shipping

Customer is responsible for shipping merchandise back to MBRIDAL and following all MBRIDAL procedures for doing so. Under no circumstances will MBRIDAL be responsible for shipping and handling of any merchandise, under any circumstances.

Section V: Restocking Fees

With merchandise returned to MBRIDAL a restocking fee, which shall not exceed 25% of the cost of the merchandise shall be applied. Restocking fee schedule is as follows:

if Item is reported defective and/or damages or if otherwise RMA is requested within 48 hours (2) calendar days of receiving item(s), Restocking fee is 0%
if Item is reported defective and/or damages or if otherwise RMA is requested within seven (7) calendar days of receiving item(s), Restocking fee is 20%
if Item is reported defective and/or damages or if otherwise RMA is requested within beyond seven (7) calendar days of receiving item(s), Restocking fee is 25%

Section VI: Refused Packages and/or Items Returned Without an RMA

If you return an item to MBRIDAL without first being issued an RMA# and/or the package was refused upon delivery attempt, your purchase will incur a 50% restocking fee and/or be shipped back at customers/senders expense. This fee will be deducted directly from the issuance of store credit.

Section VII: Merchandise not Eligible for Return

Section VIII: Due to the nature of items purchased MBRIDAL assumes no responsibility in variances in your measurements from the time that the original order was placed to the time that your order was/is received. Size inaccuracy due to improper measuring or size fluctuations is not and will not be considered justification for return, exchange and/or refund.

Unfortunately, due to the special nature of this merchandise, we are unable to accommodate refunds or exchanges under any circumstances for Bridal Gowns and/or special-order products, Jewelry, Handbags, Undergarments, Swimwear, Bridal Accessories and Sunglasses are not eligible for return. In addition, Special Order items, Sale items, and items purchased in our Showroom are not eligible for return. Items purchased online may not be returned at our showroom location(s). ALL sales of these items are final and cannot be cancelled at the point after 24 hours of purchase. Any cancellation after 24 hours up to seven (7) calendar day of purchase will have a 20% restocking fee applied. No cancellation will be offered after seven (7) calendar days.

Please allow for 7 - 10 business days for domestic delivery and 7 - 30 business days for international delivery. These delivery time frames are estimates only and actual delivery may vary. Section V: Additional Charges
